Terms and conditions governing your use of Nano Banana services

These Terms of Service apply to your access to or use of Nano Banana (the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you use the Service on behalf of an organization, you represent and warrant that you have the authority to accept these Terms on its behalf.
The Service is an AI-based image generation and editing web service. We may from time to time update, upgrade, adjust, add, or discontinue features to improve stability, security, and user experience.
For changes that do not affect your core use, we may not provide separate notice. For changes that may materially impact paid features, key workflows, or availability, we will provide reasonable notice via on-site announcements, email, or in-product prompts.
If you purchase subscriptions or credits, you agree to pay the applicable fees according to the price and billing rules shown at the time of purchase (including applicable taxes and payment processing fees).
We may adjust subscription pricing or credit pricing in the future. If a price change affects a paid plan you are currently using, we will notify you in advance on the website or via email/in-product prompts, and give you the opportunity to cancel or change your plan before the new price takes effect (except for changes required by law or tax).
Refunds and cancellations are governed by our Refund Policy.

When not using traditional password login, requirements related to password complexity or initial password changes do not apply. You must still safeguard your login methods and device security, and you are responsible for all activity under your account.

We commit to replying within 48 hours of receiving your email (typically on business days; complex issues may take longer, but we will acknowledge and keep you updated).
Important notices related to the Service may be delivered via on-site announcements, in-product prompts, or email to the address associated with your account.
In these Terms, "Confidential Information" means information disclosed by one party to the other in written or oral form during cooperation or use that should reasonably be considered confidential (including but not limited to business information, technical information, internal materials, non-public plans, etc.).
Except as necessary to provide the Service or required by laws and regulations, we will not disclose your non-public content or data submitted to the Service to any third party. Both parties shall take reasonable security measures to protect Confidential Information against unauthorized access, use, or disclosure.
The following are not Confidential Information: information that is public, becomes public through no fault of the receiving party, is lawfully obtained by the receiving party independently, or must be disclosed by law/regulation (where possible, we will provide reasonable notice before disclosure).
You retain your rights and ownership (as applicable) in the content you submit, upload, generate, publish, or otherwise provide through the Service ("User Content").
You grant us a worldwide, non-exclusive, royalty-free limited license solely for the following purposes:
Unless we have your explicit authorization or are required by law, we will not use your User Content for marketing promotion or public display.
Unless you explicitly opt in (e.g., via a future optional toggle), we will not use your User Content to train Nano Banana's own general machine learning or generative AI models.
To fulfill the generation or editing requests you initiate, we may submit necessary data to trusted third-party infrastructure or third-party AI inference/processing service providers for processing. The data is submitted solely to complete your request and ensure service security (e.g., anti-abuse, troubleshooting), and we follow data minimization where possible. Third parties' processing is governed by their own terms and policies.
If your organization has stricter requirements on third-party processing (e.g., requiring that third parties not use data for improvement/training, or requiring specific data retention/deletion rules), please contact us at support@nanobananana.com before use. We will evaluate and make commercially reasonable efforts to provide feasible enterprise configurations or alternative processing options.
We take reasonable technical and organizational measures to protect User Content and personal information. See our Privacy Policy for details.
You agree not to:
If you violate these Terms, engage in abusive behavior, or we believe there are security/legal risks, we may suspend or restrict your access to the Service, or terminate your account, to the extent necessary.
You may stop using the Service at any time. If you are a paid user, cancellations and refunds are governed by our Refund Policy.
We may stop or terminate the Service or parts of it in the following circumstances: business adjustments, major technical changes, legal or regulatory requirements, or security reasons.
For complete shutdown of paid services or removal of major features, we will try to provide reasonable advance notice (typically no less than 30 days) so you have time to export or save necessary content. If emergency suspension is required due to security incidents, legal requirements, or force majeure, we may not be able to provide advance notice, but will notify you of the reason and next steps as soon as feasible.
The Service is provided "as is" and "as available" without any express or implied warranties. We do not guarantee that the Service will be uninterrupted, fully secure, or error-free, nor that the generated results will meet your specific purpose.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, or business interruption.
Where applicable law does not allow the exclusion or limitation of certain liabilities, such limitations apply to the extent permitted by law.
We may update these Terms from time to time. The updated Terms will be posted on this page and will take effect upon posting. For material changes, we will provide reasonable notice. Your continued use of the Service after the update constitutes acceptance of the updated Terms.
